These Terms & Conditions (“Terms”) apply to all purchases of products (“Goods”) from Elite Design Studio (“Seller”). By placing an order, the Customer acknowledges and agrees to be bound by these Terms.


1. Definitions

  • Seller: Elite Design Studio (operated by Ziad Youssef).

  • Customer: Any purchaser (consumer or business) buying Goods from the Seller.

  • Goods: Tiles, vanities, basins, tapware, showers, accessories, or any other products supplied by the Seller, including packaging and pallets.


2. Samples

Elite Design Studio offers sample tiles to assist Customers with selection.

Samples may attract a fee, and delivery charges may apply.

If promotional sample coupons are offered:

  • Coupons may only be used once per Customer.

  • They may be valid for a limited time (e.g., 6 months) as printed on the promotional material.

  • Lost or missing coupons may be reissued at the Seller’s discretion.

Recommendation to Order Samples

We strongly recommend requesting / ordering samples before placing a full order.

Samples help Customers confirm colour, finish, pattern, and suitability under their own lighting and space conditions.

Non-Refundable

All sample purchases are strictly non-returnable and non-refundable, including delivery fees.

If a sample arrives damaged, the Seller may, at its discretion replace it subject to availability and freight charges.


3. Quotations & Orders

 

Quotation Validity

Unless otherwise stated, quotations remain valid for 30 days.

A quotation is an invitation to order and not a binding offer. The Seller may revise or withdraw a quotation at any time before an order is submitted referencing that quote.

Placing Orders

Customers must provide accurate:

  • Contact and delivery details

  • Product codes, names, quantities, and descriptions

  • Delivery or pickup date (minimum 48 hours notice)

 

Right to Accept or Reject Orders

The Seller may reject an order for reasons including (but not limited to):

  • Incorrect or incomplete order information

  • Expired quotation

  • Out-of-stock items

  • Pricing errors

  • Suspicion of fraudulent activity


4. Acceptance of Orders

  • An order submitted by the Customer is an offer to purchase.

  • The order becomes binding only when the Seller issues a written Order Confirmation.

  • Payment received does not constitute acceptance.

  • If an order is declined, the Customer will receive a refund within 14 days.

No Changes After Confirmation

After an Order Confirmation is issued, the Customer cannot modify, cancel, or change the order unless permitted under the cancellation policy.


5. Delivery of Orders

Processing & Dispatch

We will do our best to pack and dispatch orders as soon as possible, some orders could take up to 48 hours for packing and dispatching. Customers will receive packing and dispatch notifications.

Cut-off time for orders is 10:00am, any orders placed after 10:00am will get registered in te system on the following business day.

Delivery Conditions

Deliveries occur Monday–Friday, 9:00 am–5:00 pm.

Delivery is to the nearest accessible point (e.g., curbside) based on site access and vehicle restrictions.

Pallet jack access is not guaranteed. Tailgate, forklift, or crane truck deliveries may be used depending on the order.

Customer Responsibilities

The Customer must:

  • Ensure safe and accessible delivery conditions

  • Notify the Seller of special access conditions beforehand

  • Have an authorised person onsite to receive the order

If delivery cannot be completed due to Customer-related issues, re-delivery fees or storage fees may apply.

Delivery Dates

Delivery dates and times are estimates only.

The Seller is not liable for:

  • Delays from transport companies

  • Project delays or installer fees

  • Any indirect loss caused by late delivery

Customer Pickup

For warehouse pickups, Customers (or their couriers) must inspect Goods before leaving.

Once Goods leave the warehouse, the Seller is not responsible for any damages.


6. Damaged or Incorrect Goods

Inspection

Customers must inspect Goods immediately upon delivery or pickup.

Damage or Shortage Claims

Claims must be made within 24 hours of receiving the order.

Customers will need to provide photos and retain packaging.

Limitations

  • Claims after 24 hours may not be accepted.

  • No claims accepted once Goods are installed. Installation = acceptance.

  • Goods moved after delivery (e.g., to job sites) may void damage claims.

Resolution Options

If the Seller confirms an issue, we may:

  • Replace items, or

  • Provide a refund/credit for affected items


7. Cancellation of Orders

Custom / Special-Order Items

Custom-made, factory-ordered, specially sourced, or non-stock items:

  • Cannot be cancelled

  • Are non-returnable and non-refundable

Eligibility to Cancel (Regular Stock Only)

Order cancellation may be accepted only if:

  • Requested within 24 hours

  • Goods have not been packed or dispatched

  • Goods are not on sale, clearance, or custom-ordered

Requests must be in writing.

Non-Eligible for Cancellation

Orders cannot be cancelled if Goods are:

  • Packed

  • Ready for pickup

  • Dispatched

  • Delivered

Cancellation Fees

If accepted:

  • A 5% cancellation fee applies

  • A higher fee (up to 25%) may apply in special circumstances at Seller’s discretion


8. Packing of Orders

The Seller packs orders appropriately for transport based on product type, distance, and handling requirements.

The Customer must unpack Goods carefully to avoid damage.


9. Price & Payment

Pricing

All prices are in AUD and include GST unless otherwise stated.

Payment

Full payment (including freight) is required at checkout.

Orders are not processed until payment is received.

Delivery Charges

Delivery charges are additional unless stated otherwise.

No Set-Off

Customers cannot deduct or withhold payments unless agreed in writing.

Deposits

If the Seller accepts a deposit:

  • Deposits are non-refundable

  • Failure to pay the balance results in forfeiture

Price Adjustments (Imports or Special Orders)

Prices may be adjusted for changes in:

  • Freight

  • Exchange rates

  • Duties

  • Insurance

Customers will be notified and may accept or cancel (if applicable).


10. Returns & Refunds

(applies only to orders that have already been dispatched)

Custom / Special-Order Items

Strictly non-returnable and non-refundable.

Return Period

Return requests must be made within 14 days of:

  • Dispatch date, or

  • Delivery date (whichever is later)

Return Conditions

Goods must be:

  • Unused

  • Undamaged

  • Uninstalled

  • In original packaging

Returns will be rejected if Goods are:

  • Marked, chipped, cut, or installed

  • Without original packaging

  • Modified in any way

  • Purchased as clearance, sale, or special order

Restocking Fee

Change-of-mind returns incur a 25% restocking fee.

Freight Costs

  • Return freight is the Customer’s responsibility

  • Original delivery fees are non-refundable

Inspection & Refund

Refunds are processed only after inspection and confirmation that Goods are resalable.


11. Storage Fees

Elite Design Studio provides up to 30 days free storage once Goods are ready.

After this period:

  • $25 per pallet per week applies

  • Fees must be paid before release

Uncollected Goods after 90 days may be resold or disposed of at Seller’s discretion.


12. Limitation of Liability

To the maximum extent permitted by law, the Seller’s liability is limited to:

  • Replacement of the Goods, or

  • A refund equal to the cost of the affected Goods

Natural Variations

Tiles may vary in:

  • Colour

  • Pattern

  • Shade

  • Size

  • Finish

Such variations are normal and not considered defects.

No Liability for Project Costs

The Seller is not liable for:

  • Installers booked based on estimated delivery dates

  • Labour costs

  • Removal/reinstallation

  • Indirect or consequential losses

Optical Hazing

Polished porcelain tiles may exhibit optical hazing.

This is not a defect and is not covered by warranty.

Statutory Rights

Nothing in these Terms limits the Customer’s rights under the ACL.


13. Force Majeure

The Seller is not liable for failure or delay caused by events beyond reasonable control, including:

  • Natural disasters

  • Pandemics

  • Transport delays

  • Strikes

  • Government restrictions

  • Accidents or supply disruptions


14. General Provisions

Governing Law

These Terms are governed by the laws of Queensland, Australia.

Changes to Terms

The Seller may update Terms at any time.

Revised Terms apply to new orders only.

Title (Ownership)

Ownership transfers to the Customer only after full payment is received.

Risk

Risk transfers upon delivery to the Customer’s address or collection by Customer’s courier.

Entire Agreement

These Terms and the Order Confirmation constitute the entire agreement.

Severability

If any clause is invalid, remaining clauses remain enforceable.
